Compliance with European Data Protection Law and Regulation is a foundational concept within the Certified Information Privacy Professional/Europe (CIPP/E) framework. It primarily revolves around adherence to the General Data Protection Regulation (GDPR), which came into effect on May 25, 2018, and serves as the cornerstone of data protection across the European Union (EU) and European Economic Area (EEA). Organizations must comply with key principles outlined in the GDPR, including lawfulness, fairness, and transparency in data processing; purpose limitation, ensuring data is collected for specified, explicit, and legitimate purposes; data minimization, collecting only what is necessary; accuracy, keeping data up to date; storage limitation, retaining data only as long as needed; and integrity and confidentiality, ensuring appropriate security measures. Compliance requires organizations to establish a lawful basis for processing personal data, such as consent, contractual necessity, legal obligation, vital interests, public task, or legitimate interests. Organizations must also uphold data subject rights, including the right to access, rectification, erasure, restriction of processing, data portability, and the right to object. Key compliance obligations include conducting Data Protection Impact Assessments (DPIAs) for high-risk processing activities, appointing a Data Protection Officer (DPO) where required, implementing data protection by design and by default, maintaining records of processing activities, and reporting personal data breaches to supervisory authorities within 72 hours. Organizations transferring personal data outside the EU/EEA must ensure adequate safeguards, such as Standard Contractual Clauses (SCCs), Binding Corporate Rules (BCRs), or adequacy decisions. Non-compliance can result in significant penalties, with fines reaching up to €20 million or 4% of global annual turnover, whichever is higher. Beyond the GDPR, compliance also encompasses the ePrivacy Directive, national data protection laws of EU member states, and sector-specific regulations.
