European Data Processing

European Data Processing refers to the handling, management, and manipulation of personal data within the framework of European data protection laws, primarily governed by the General Data Protection Regulation (GDPR). Data processing encompasses any operation performed on personal data, whether automated or manual, including collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, alignment, combination, restriction, erasure, or destruction. Under the GDPR, data processing must adhere to key principles outlined in Article 5. These include lawfulness, fairness, and transparency; purpose limitation, meaning data must be collected for specified, explicit, and legitimate purposes; data minimization, ensuring only necessary data is processed; accuracy; storage limitation; integrity and confidentiality; and accountability. For processing to be lawful, it must rely on one of six legal bases defined in Article 6 of the GDPR: consent of the data subject, performance of a contract, compliance with a legal obligation, protection of vital interests, performance of a task carried out in the public interest, or legitimate interests pursued by the controller or a third party. Data processing involves two key roles: the data controller, who determines the purposes and means of processing, and the data processor, who processes data on behalf of the controller. Both parties have specific obligations, and their relationship must be governed by a formal data processing agreement. Special categories of personal data, such as racial or ethnic origin, political opinions, religious beliefs, health data, and biometric data, are subject to stricter processing conditions under Article 9. Organizations must also conduct Data Protection Impact Assessments (DPIAs) when processing is likely to result in high risks to individuals' rights and freedoms. Additionally, cross-border data transfers outside the European Economic Area require appropriate safeguards, such as Standard Contractual Clauses or adequacy decisions, to ensure equivalent levels of data protection.
