Introduction to European Data Protection

European Data Protection is a comprehensive legal framework designed to protect individuals' personal data and privacy rights across the European Union (EU) and European Economic Area (EEA). Its foundations are rooted in fundamental rights, particularly Article 8 of the European Convention on Human Rights and Article 8 of the EU Charter of Fundamental Rights, which explicitly recognize the right to protection of personal data. The cornerstone of European data protection is the General Data Protection Regulation (GDPR), which came into effect on May 25, 2018, replacing the earlier Data Protection Directive 95/46/EC. The GDPR harmonizes data protection laws across EU member states, establishing a unified framework for how organizations collect, process, store, and share personal data. Key principles of European data protection include lawfulness, fairness, and transparency; purpose limitation; data minimization; accuracy; storage limitation; integrity and confidentiality; and accountability. These principles guide organizations in responsibly handling personal data while respecting individuals' rights. The framework grants individuals several important rights, including the right to access their data, the right to rectification, the right to erasure (right to be forgotten), the right to data portability, and the right to object to processing. Organizations must also obtain valid consent or establish another lawful basis before processing personal data. Enforcement is carried out by independent supervisory authorities (Data Protection Authorities) in each member state, coordinated through the European Data Protection Board (EDPB). Non-compliance can result in significant fines of up to €20 million or 4% of global annual turnover, whichever is higher. The framework also addresses cross-border data transfers, requiring adequate protection levels when personal data leaves the EU/EEA. Mechanisms such as Standard Contractual Clauses, Binding Corporate Rules, and adequacy decisions facilitate lawful international data transfers.
