In the United States, workplace privacy is governed by a patchwork of federal and state laws rather than a single comprehensive statute. Federal laws such as the Electronic Communications Privacy Act (ECPA), the Fair Credit Reporting Act (FCRA), the National Labor Relations Act (NLRA), and the Genetic Information Nondiscrimination Act (GINA) establish certain employee privacy rights. Employers are generally expected to provide clear privacy policies, inform employees about monitoring practices, and limit data collection to what is necessary for business purposes. The evolving nature of technology, including remote work tools, biometric systems, and artificial intelligence in hiring, continues to present new workplace privacy challenges. CIPP/US professionals must stay current with emerging laws and best practices to help organizations navigate these complexities while respecting employee privacy rights and minimizing legal risk.
